How can i remove a name from a birth certificate?

my ex husband and I have a 3 month old baby, we broke up recently due to him cheating. he came to my house last week and beat me up infront of my child. i want to have hes name removed off the birth certificate as when we married i kept my own name, so we put mine and hes surname on the birth certificate. he has a history of voilence and i believe its in my childs best interest not to have him around. would i be able to have hes surname removed of the birth certificate? i dont know that he would agree so what are my rights if he disagrees?
